Papillon is a 2021 Jeanneau Sun Odyssey 440 sloop rigged sailing yacht with an overall length of 44 feet and a beam of 14 feet. Cozy and sporty, the Sun Odyssey 440 delivers extra comfort and accommodations to facilitate life on board. She comfortably accommodates up to six passengers in the cockpit. The Sun Odyssey 440 received Cruising World magazine’s prestigious Boat of the Year Award in 2018.

Joseph Krensavage is a graduate of the United States Naval Academy. I subsequently served as a Naval Officer aboard two ships:
· USS Ingersoll, DD-990, 9,000 tons, 1989-1990, Officer of the Deck Qualified, 20,000 nautical miles of sea service, Pearl Harbor to the Arabian Gulf for Operation Earnest Will and return to Pearl Harbor.
· USS Texas, CGN-39, 11,00 tons, 1991-1992, Officer of the Deck qualified, 20,000 nautical miles of sea service, San Diego to the Arabian Gulf and return to the Alameda Naval Base. Eighty-seven days served in a combat zone during Desert Storm as the Engineering Officer of the Watch supervising the operation and maintenance of two 80 megawatt nuclear reactor propulsion and power plants.
Joseph Krensavage has been sailing since 1982 beginning on a Rhodes 19 in Newport, Rhode Island. At the Naval Academy Preparatory School in Newport, Rhode Island, I served as crew aboard the N.E.T.C Newport, a 50’ sloop and raced in the 1983 race from Marion, Massachusetts to Bermuda. At the U.S. Naval Academy, I was a member of the varsity offshore sailing team for one year racing Rattlesnake, a 62’ ketch in multiple races including the 1984 Block Island Race and the 1984 Newport to Bermuda race. My San Francisco Bay sailing experience includes 30+ years day sailing and racing from 1994 to the present day. In the early 1990s, I skippered Eggbert, a Catalina 27 many times over several years. In the mid 1990s, I taught Basic Keelboat sail training at the Presidio Yacht Club and served as a charter skipper aboard Warrior, a Catalina 30 for U.S. Air Force personnel from Travis Air Force Base. I owned, raced and cruised Mustang, an Islander 36 from 2001 – 2008. I served as race crew on multiple sail boats including: Pulp Friction, an Olson 25, Melange, an Express 37 and Eos, a Knarr 30. In October, 2020 I took delivery of Papillon, a 2021 Jeanneau Sun Odyssey 440.
In the event of inclement weather (e.g., rain) leading to a cancellation at the captain's discretion, we will either reschedule your trip, offer a gift certificate, or provide a full refund (inclusive of any fees). We will remain in contact with you to monitor weather forecasts. Since weather conditions can change rapidly in the Bay Area, we generally hold off on cancellations until the last moment. Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.
Charter Contract By booking a charter through our website, you agree to enter into our Charter Contract. The terms and conditions of the Charter Contract are incorporated herein by reference and form an integral part of these Terms and Conditions. You must read, understand, and agree to the Charter Contract before making a booking.
Booking and Payments By making a booking with us, you agree to the terms of our Charter Contract. Full payment of the charter fee is required at the time of booking confirmation. If the charter is booked less than 2 days prior to the charter date, full payment is required immediately.
Cancellations and Refunds Cancellations and refunds are subject to the terms set forth in our Refund Policy.
Changes to Booking If you wish to make changes to your booking, you must notify us in writing. We will do our best to accommodate your request but cannot guarantee that changes can be made. Additional charges may apply for changes made to the booking.
User Conduct. As a user of our Service, you agree to abide by all applicable laws and regulations and to act in a responsible and courteous manner while using the Vessel. You also agree to comply with the terms of our Charter Contract.
Governing Law. These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through arbitration or other appropriate dispute resolution procedures.
Changes. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

Terms and Conditions - Charter
COVENANT TO SUE, RELEASE, AND INDEMNITY
FOR ENTRY AND USE OF THE Sailing Yacht “Papillon”
For and in consideration of the acceptance by Charterer & Guests of entry and use of the VESSEL, I hereby acknowledge the dangers inherent in VESSEL ACTIVITIES and accept all the risks and responsibilities of my participation. I am agreeing to release “Papillon Yacht Charters LLC” and its AFFILIATES from liability.
DEFINITIONS
● VESSEL means the Official Number 1311695 and her apparel, tackle,
furniture, appurtenances, tenders, boats, and toys.
● AFFILIATES means parent, affiliated, or subsidiary companies; officers,
employees, contractors, volunteers, agents or representatives, insurers, attorneys,
and their successors and assigns; and all of their vessels and facilities.
● VESSEL ACTIVITIES include all uses of the VESSEL whether at dark, anchor, or
underway.

RECOGNITION OF RISKS
Charterer & Guests recognize that there are risks involved in VESSEL ACTIVITIES. Risk of serious bodily injury, including permanent disability, paralysis and death may arise from slips, trips, or falls, perils of the sea, severe weather, negligence of other VESSEL guests, caterers, crew, or other boaters; flaws and defects in equipment and facilities. Risks make because by my own actions, or inaction, the actions or inaction of others, and/or the negligence of “Papillon Yacht Charters LLC” and its AFFILIATES. There may be other risks and social and economic losses either not known to me or not readily foreseeable at this time. I recognize that the risks of VESSEL ACTIVITIES are potentially more severe than the risks I am accustomed to ashore. Some of the significant risks associated with VESSEL ACTIVITIES include, without limitation:
● Slipping and falling on the docks, ramps, and VESSEL. There is a possibility of
falling into the water and drowning. Surfaces may be wet and slippery.
Additionally, there is a possibility of being crushed between the VESSEL, piers or
other boats, which may result in severe injuries or death.
● The surfaces a board vessels are hard and unforgiving. Falling on the deck of the
VESSEL may result in severe injuries or death.
● There are trip hazards on VESSEL, including cleats, lines and ropes, and uneven
surfaces, particularly near doors and hatches.
● The VESSEL may rock or roll in the event of wind or wave action. Rocking and
rolling may result in loss of balance, falling, or colliding into hard surfaces or the
water. Rocking and rolling of the VESSEL may also lead to damage of property
(such as phones, cameras, computers, falling from tables and breaking) or injury
from falling objects (such as hot beverages falling on seated individuals).
● When transferring between the VESSEL and other vessels, waves, swells, or wakes
may cause the vessels to surge together or apart rapidly, potentially resulting in
falling in the water, or being crushed between the vessels.
● Stairs on the VESSEL may be significantly steeper than shore-side facilities. Stairs
may be wet and slippery. The VESSEL may roll or pitch while I am on the stairs,
resulting in my fall and injury.
● Emergency help may be delayed because the VESSEL is not easily accessible from
Shore.
● The risks outlined above are examples only.

RISKS INCREASE WITH ALCOHOL AND DRUGS
Further, recognize that impairment from alcohol and drug use may increase the risk
associated with VESSEL ACTIVITIES. Charterer agrees that Charterer and Charterer’s guests will use alcohol only in moderation, if at all, and that Charterer will not use any drugs in violation of law or medical advice.
AGREEMENTS:
Charterer agrees to abide by all instructions from the VESSEL’s master and crew related to safety.
Charterer agrees to report any and all accidents, injuries, or property damage, as soon as possible and in any event prior to departing the VESSEL.
Charterer hereby releases, waives, and relinquishes Charterer’s rights and guest rights to the fullest extent permitted by law, to any and all claims of any sort whether in tort, contract, equity, or otherwise, which I, my heirs, administrators, executors, and assigns may or could have against the VESSEL “Papillon”, or their AFFILIATES, arising out of or in any way connected with my entry aboard the VESSEL or VESSEL ACTIVITIES, for injuries, death or property damage which I or they may suffer or sustain.
In addition to the release and waiver of liability described above, I agree that I shall
indemnify, defend, and hold harmless the VESSEL, “Papillon”, or their AFFILIATES for
any costs or liabilities which they may incur as a result of my participation in VESSEL
ACTIVITIES. If any lawsuit, action, or legal proceeding should be brought against the
VESSEL, “Papillon”, and/or their AFFILIATES by reason of any such claims or alleged
liability, Charterer agrees to defend such action or proceeding at Charterer’s sole expense by counsel reasonably satisfactory to “Papillon”, and its AFFILIATES.
I further expressly agree that the foregoing release, waiver, and assumption of risk is
intended to be as broad and inclusive as permitted by law and that if any portion, clause,
or sub-clause here of is held invalid, it is agreed that the balance shall, notwithstanding,
continue in full force and legal effect.
CHARTERER HAS CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS.
CHARTERER IS AWARE THAT THIS IS A RELEASE, WAIVER OF LIABILITY, AND ASSUMPTION OF RISK. CHARTERER FURTHER UNDERSTAND CHARTERER IS AGREEING TO INDEMNIFY “PAPILLON” AND ITS AFFILIATES.
CHARTERER IS WAVING SIGNIFICANT LEGAL RIGHTS.
